«برنامه نظارت بر حمایت از مدافعان حقوق بشر»، که برنامه مشترک «فدراسیون بین المللی جامعه های حقوق بشر» (FIDH) و «سازمان جهانی مبارزهبا شکنجه» (OMCT) است، اطلاعات تازه ای دریافت کرده و از شما درخواست می کند فوری در باره مساله زیر در ایران اقدام کنید.

برنامه نظارت بر حمایت از مدافعان حقوق بشر از طریق «کانون مدافعان حقوق بشر» (DHRC) (عضو فدراسیون بین المللی جامعه های حقوق بشر) از محکومیت آقای هادی اسماعیل زاده، وکیل حقوق بشری ایرانی و عضو کانون مدافعان حقوق بشر مطلع شده است.
بنا به اطلاعات دریافتی آقای هادی اسماعیل زاده اخیرا از صدور حکم محکومیت خود در شعبه 15 دادگاه انقلاب اسلامی به مجموع چهار سال زندان، شامل سه سال به اتهام «اجتماع و تبانی به قصد ارتکاب جرایم امنیتی» به لحاظ عضویت در «سازمان غیرقانونی»، یعنی کانون مدافعان حقوق بشر، و یک سال به اتهام «فعالیت تبلیغی علیه نظام» مطلع شد. به علاوه، دادگاه او را به مدت دو سال از اشتغال به حرفه وکالت محروم کرده است. آقای اسماعیل زاده علیه این حکم اعتراض خواهد کرد و در حال حاضر آزاد است.
برنامه نظارت یادآوری می کند که در حال حاضر آقایان عبدالفتاح سلطانی و محمد سیف زاده، دو وکیل حقوق بشری دیگر و اعضای بنیانگذار کانون مدافعان حقوق بشر، به اتهام های ناشی از فعالیت های حقوق بشری حکم های طولانی محکومیت را در زندان های اوین تهران و رجایی شهر کرج سپری می کنند. گروه تحقیق در باره حبس های خودسرانه سازمان ملل در ژانویه 2013 اعلام کرد که حبس آقای سلطانی خودسرانه است. آقای سلطانی دچار بیماری های جدی است ولی از دسترسی کافی به مراقبت مناسب پزشکی در زندان یا در مراکز پزشکی خارج از زندان برخوردار نیست.
برنامه نظارت بر حمایت از مدافعان حقوق بشر نگرانی شدید خود را از آزار قضایی مداوم آقای اسماعیل زاده و دیگر اعضای کانون مدافعان حقوق بشر ابراز می کند و از دولتمردان ایران می خواهد به آزار او، از جمله در سطح قضایی، پایان دهند و تمام اتهام های علیه او را لغو کنند.
اطلاعات پیشینه ای
آقای هادی اسماعیل زاده روز 26 فروردین ماه 1393 در شعبه 15 دادگاه انقلاب اسلامی محاکمه شد. پیشتر در بازپرسی به تاریخ ٢١ تیرماه 1390، اتهام های «اجتماع و تبانی به قصد ارتکاب جرایم امنیتی» به لحاظ عضویت آقای اسماعیل زاده در کانون، و «فعالیت تبلیغی علیه نظام» گویا به خاطر نوشتن گزارش های ماهانه کانون مدافعان حقوق بشر و ارسال آنها برای سازمان‌های حقوق بشری از جمله شورای حقوق بشر سازمان ملل، و فعالیت در کميته انتخابات آزاد، سالم و عادلانه و بیانیه این کمیته پيش از انتخابات ریاست جمهوری سال 1388 به وی ابلاغ، و سفر او به خارج نیز ممنوع شده بود. آقای اسماعیل زاده پیش از محاکمه اجازه خواندن پرونده را نیافت، اما به وکلای او امکان دسترسی به پرونده و اجازه مطالعه آن داده شد. پس از محاکمه، قاضی به او گفت که در صورت تمایل به رفع ممنوعیت سفر به خارج، او باید با «کارشناسان پرونده وارد مذاکره» شود یعنی با بازجویان وزارت اطلاعات که پرونده را برای دادگاه تنظیم کرده اند.
برنامه نظارت یادآوری می کند که در پی تعطیلی دفتر کانون مدافعان حقوق بشر در سال 1387، سازمان های اطلاعاتی و امنیتی چندین بار آقای اسماعیل زاده را احضار و بازجویی کردند و برای استعفا از کانون مدافعان حقوق بشر زیر فشار قرار دادند. به علاوه، خودداری او از استعفا از عضویت در کانون باعث اخراج او از موسسه عالی بانکداری ایران در سال 1388 و سپس از دانشگاه آزاد اسلامی ـ واحد بم در سال 1391 شد. آقای اسماعیل زاده طی 1367 ـ 1361 شش سال در زندان بود.
اقدام های درخواستی:
برنامه نظارت از همگان می خواهد با نوشتن نامه به دولتمردان ایران از آنها بخواهند:
- تحت هر شرايطی، سلامت روحی و جسمانی آقای هادی اسماعیل زاده و تمام مدافعان حقوق بشر در ايران را تضمين کنند؛
- آقایان عبدالفتاح سلطانی و محمد سیف زاده و تمام مدافعان حقوق بشر در ايران را که تنها برای مجازات فعالیت های حقوق بشری آنها در زندان هستند فوری و بدون قید و شرط آزاد کنند؛
- به هرگونه اقدام آزاردهنده، ازجمله در سطوح قضايی، علیه آقایان هادی اسماعیل زاده، عبدالفتاح سلطانی و محمد سیف زاده و تمامی دیگر مدافعان حقوق بشر در ايران پايان دهند و امکان انجام فعالیت های بدون مانع آنها را در هر شرایطی تضمین کنند؛
- در هر شرایطی اعلاميه سازمان ملل در باره مدافعان حقوق بشر را، که در تاريخ ۱۸ آذر ۱۳۷۷ (۹ دسامبر ۱۹۹۸) در مجمع عمومی سازمان ملل تصويب شده، رعايت کنند، به ویژه:
– ماده 1 آن که می گويد: «همه افراد حق دارند به صورت فردی يا گروهی در سطوح ملی و بين المللی برای حمايت از حقوق بشر و آزادی های اساسی و تحقق این حقوق و آزادی ها فعالیت کنند،»
– و ماده 2ـ12 آن که می گويد: «دولت بايد کليه تدبيرهای لازم را به کار گیرد تا حمايت مراجع ذیصلاح از همه افراد به صورت فردی و گروهی در برابر خشونت، تهديد، اقدامات تلافی جويانه، تبعيض منفی عملی و يا قانونی، فشار یا هرگونه اقدام خودسرانه ديگر در پی استفاده مشروع و قانونی اين افراد از حقوق مذکور در اعلاميه حاضر، تضمين گردد؛»
- در هر شرایطی تضمین کنند که حقوق بشر و آزادی های اساسی مطابق با موازین بین المللی حقوق بشر و عهدنامه های بین المللی که ایران نیز متعاهد آنهاست رعایت خواهند شد.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), has received new information and requests your urgent intervention in thefollowing situation in the Iran.
New information:
The Observatory has been informed by the Defenders of Human Rights Centre (DHRC) of the sentencing of Mr. Hadi Esmaeilzadeh, a human rights lawyer and member of the DHRC.
According to the information received, Mr. Hadi Esmaeilzadeh was recently informed of his sentencing on May 31, 2014 by Branch 15 of the Islamic Revolution Court to a total of four years of imprisonment, including three years for the charge of “assembly and collusion with intent to commit anti-security crimes” based on membership of “an illegal organisation” – i.e. the DHRC – and one year for “spreading propaganda against the State.” In addition, the court banned him from practising as a lawyer and membership of political groups and parties for two years. Mr. Hadi Esmaeilzadeh is appealing the sentence and remains free in the meantime.
The Observatory recalls thatMessrs. Abdolfattah Soltani and Mohammad Seifzadeh, two other human rights lawyers and co-founders of the DHRC, are currently serving long-term prison sentences in Tehran’s Evin prison and Karaj’s Rajaishahr prison, respectively, on charges related to their human rights activities. In January 2013, the United Nations Working Group on Arbitrary Detention declared that Mr. Soltani’s detention was arbitrary. Mr. Soltani suffers from serious health problems but does not have adequate access to proper medical care in detention or outside medical facilities.
The Observatory expresses its deep concern with the ongoing judicial harassment against Mr. Esmaeilzadeh and other DHRC members, and calls on the Iranian authorities to end all kinds of harassment against him, including at the judicial level and to drop all the charges against him.
Background information:
On April 15, 2014, Mr. Hadi Esmaeilzadeh was tried by Branch 15 of the Islamic Revolution Court. During a preliminary interrogation on July 12, 2011, he was notified of the charges of “assembly and collusion with intent to commit anti-security crimes” based on his membership of DHRC, and “spreading propaganda against the State”, for allegedly writing the monthly reports of the DHRC and sending them to human rights organisations including the UN Human Rights Council, as well as his activity in the Fair, Healthy and Free Elections Committee and the Committee’s statement before the 2009 presidential elections. He was also banned from travelling abroad. He was not allowed to read his file before the trial, but his lawyers were given the opportunity to read it. The judge told him after the trial that if he wished the ban on his travel abroad to be lifted, he had to “negotiate with the file experts”, his interrogators at the Ministry of Intelligence who prepared the file for the court.
The Observatory recalls that since the closure of the DHRC’s offices in 2008, Mr. Hadi Esmaeilzadeh has faced several interrogations by intelligence and security organisations as well as pressures to resign from the DHRC. He was also expelled from the Higher Institute of Banking of Iran in 2009 and from the Islamic Azad University-Bam Unit in 2012 because he refused to resign from the DHRC. He served six years in prison from 1982-1988.
Actions requested:
Please write to the Iranian authorities and ask them to:
- Guarantee in all circumstances the physical and psychological integrity of Mr. Hadi Esmaeilzadeh as well as of all human rights defenders in Iran;
- Release immediately and unconditionally Messrs. Abdolfattah Soltani and Mohammad Seifzadeh and all human rights defenders detained in Iran merely to sanction their human rights activities;
- Put an end to any kind of harassment – including at the judicial level – against Messrs. Hadi Esmaeilzadeh, Abdolfattah Soltani and Mohammad Seifzadeh, as well as all other DHRC members and all human rights defenders in Iran and ensure in all circumstances that they can carry out their activities without any hindrances;
- Conform in all circumstances with the provisions of the Declaration on Human Rights Defenders, adopted on December 9, 1998 by the United Nations General Assembly, in particular:
– its article 1, which states that “everyone has the right, individually or in association with others, to promote the protection and realization of human rights and fundamental freedoms at the national and international levels”,
– and its article 12.2 which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
- Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Iran.
